Education Hub — Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and participation in the Avery Aesthetics Education Hub, including The Reset Post-Summer Skin Intelligence Programme and any associated digital content, physical kit, and in-clinic services (collectively, the "Programme"). Please read these Terms carefully before purchasing or participating.

By completing your purchase, submitting the Skin Intelligence Quiz, or collecting your Reset kit, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you should not proceed with the Programme.

 

 

1.  About Avery Aesthetics

The Programme is offered by Avery Reconstructive & Aesthetic Plastic Surgery ABN [INSERT ABN], trading as Avery Aesthetics, located at [INSERT ADDRESS], Newcastle, NSW, Australia. References to "Avery," "we," "us," or "our" in these Terms refer to that entity.

2.  The Reset Programme — What Is Included

2.1  Programme Components

Upon payment of the Programme entry fee of 9.95 AUD (inclusive of GST), you will receive access to the following:

-       The Avery Skin Intelligence Quiz — a nine-question online diagnostic quiz that determines your post-summer skin type and routes your personalised content.

-       A personalised Education Module — a digital reference document matched to your primary skin type result, covering post-summer skin biology, your skin concern, and product rationale.

-       The SPF Intelligence Bonus Module — a digital guide covering UV protection and skin-type-matched SPF recommendations, unlocked upon purchase.

-       A curated physical sample kit ("Reset Kit") — a clinician-selected collection of skincare samples matched to your skin type result, available for collection in-clinic at Avery Aesthetics, Newcastle.

-       A complimentary Skin Analysis Appointment — a 20–30 minute in-clinic appointment using clinical imaging technology to provide a visual assessment of your post-summer skin. This appointment is complimentary and incurs no additional charge.

 

2.2  Programme Window

The Reset is available for purchase from Saturday 11 April 2026 and closes to new purchases on Sunday 24 May 2026 at 11:59 PM AEST (the "Programme Window"). Participants who have purchased within the Programme Window may continue to progress through their consultation and treatment pathway beyond this date.

 

2.3  What Is Not Included

The following are not included in the 9.95 entry fee and are subject to separate fees and/or clinical assessment:

-       The full Clinical Consultation (00 AUD, redeemable on product or treatment purchased on the day of that appointment).

-       Any skincare products in full size — samples are provided for trial purposes only.

-       Any treatment packages, including the Pigmentation Reset, Vascular Reset, Renewal Reset, Restore Medifacial, and Clarity Medifacial packages.

-       Any additional clinical services not expressly described in clause 2.1 above.

 

 

3.  Payment, Pricing, and GST

3.1  The Programme entry fee is 9.95 AUD inclusive of GST. Payment is processed at the time of purchase via Stripe. By entering your payment details, you authorise Avery Aesthetics to charge the fee to your nominated payment method.

3.2  The Clinical Consultation fee of 00 AUD is payable at the time of booking or on the day of that appointment, as directed by the clinic. This fee is fully redeemable on the purchase of skincare products or a treatment booked and paid for on the day of that consultation.

3.3  The 20% skincare discount available to Reset participants is activated upon booking confirmation of the full Clinical Consultation and remains valid for 30 days from the date of that consultation. The discount applies to skincare products only and cannot be applied retroactively, combined with other offers, or redeemed as cash.

3.4  All prices are in Australian dollars (AUD) and include GST unless otherwise stated.

 

 

4.  Refunds and Cancellations

4.1  Digital content (the Education Module and SPF Intelligence Bonus Module) is delivered immediately upon purchase by electronic means. In accordance with the Australian Consumer Law, by proceeding with purchase you acknowledge that you have expressly requested immediate access to this digital content and that your statutory right of withdrawal may not apply once the content has been accessed or downloaded.

4.2  Where your Reset Kit has not yet been collected and no digital content has been accessed, you may request a full refund within 48 hours of purchase by contacting us at [INSERT EMAIL]. Refunds will be processed to your original payment method within 5–10 business days.

4.3  Once your Reset Kit has been collected in-clinic, no refund is available for the 9.95 Programme fee. This does not affect your rights under the Australian Consumer Law in relation to faulty or misdescribed goods.

4.4  Cancellation of the complimentary Skin Analysis Appointment must be provided at least 24 hours before the scheduled appointment time. Appointments cancelled with less than 24 hours notice may not be rebooked within the Programme Window, subject to clinic availability. Avery Aesthetics reserves the right to apply a cancellation fee for repeated late cancellations.

4.5  Cancellation of a booked Clinical Consultation must be provided at least 24 hours before the scheduled appointment. The 00 consultation fee is non-refundable once the appointment has taken place. If the consultation is cancelled with adequate notice, the fee may be applied to a future booking within 30 days.

4.6  Nothing in these Terms limits or excludes any guarantee, condition, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

 

 

5.  Nature of the Programme — Educational Content Only

5.1  The Reset is an educational programme. The Skin Intelligence Quiz, Education Modules, SPF Intelligence Guide, and all associated digital content are provided for general educational and informational purposes only. They do not constitute, and are not a substitute for, personalised medical advice, clinical diagnosis, or treatment.

5.2  The quiz result and skin type categorisation provided are self-reported assessments based on your responses. They are not a clinical diagnosis. Avery Aesthetics does not warrant that your quiz result will correspond precisely to any clinical assessment.

5.3  The complimentary Skin Analysis Appointment provides observational clinical imaging and a brief written summary. It is not a full clinical consultation and does not constitute a treatment plan, prescribing event, or clinical recommendation. All treatment decisions require a separate full Clinical Consultation with a qualified clinician.

5.4  The sample products included in your Reset Kit are provided for personal trial use only. They are not prescribed therapeutic products. You should read all product packaging and instructions before use. If you experience any adverse reaction to a sample product, discontinue use immediately and contact Avery Aesthetics or your treating practitioner.

5.5  The educational content in the Programme references published peer-reviewed research. This content is provided for educational interest. It does not constitute a therapeutic claim or clinical guarantee for any product or treatment described.

 

 

6.  Access to Treatment Packages

6.1  Treatment packages are available exclusively to Reset participants at programme pricing during the Programme Window.

6.2  No treatment package may be booked or proceed without a full Clinical Consultation confirming suitability for the proposed treatment. Clinical suitability is at the sole discretion of the treating clinician. Avery Aesthetics reserves the right to decline to provide any treatment where it would not be clinically appropriate, regardless of a participant's interest or prior investment in the Programme.

6.3  Treatment package pricing and inclusions are as described in the programme materials current at the time of consultation. Avery Aesthetics reserves the right to amend package inclusions or pricing with reasonable notice.

 

 

7.  Intellectual Property

7.1  All content in the Programme — including but not limited to the Education Modules, SPF Intelligence Guide, quiz architecture, Skin Reset Ritual Cards, and all associated text, design, and branding — is the intellectual property of Avery Aesthetics and/or its licensors. All rights reserved.

7.2  You are granted a personal, non-transferable, non-exclusive licence to access and use the digital content for your own personal, non-commercial purposes during the Programme Window.

7.3  You must not reproduce, share, sell, sublicense, publish, or otherwise distribute any Programme content without the prior written consent of Avery Aesthetics. Sharing your unique access link with another person is not permitted.

 

 

8.  Privacy and Personal Information

8.1  Avery Aesthetics collects personal information — including your name, email address, payment details, and quiz responses — for the purpose of delivering the Programme, processing payment, and communicating with you about your participation.

8.2  Your quiz result and any clinical information obtained during the Skin Analysis Appointment or Clinical Consultation are treated as health information and handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and applicable health privacy legislation in New South Wales.

8.3  Your personal information will not be sold to third parties. It may be shared with service providers who assist in delivering the Programme (including payment processing via Stripe and email delivery platforms), who are bound by confidentiality obligations consistent with these Terms.

8.4  By providing your email address at purchase, you consent to receive transactional emails related to the Programme. You may opt out of marketing communications at any time via the unsubscribe link in any email.

8.5  For more information, please refer to the Avery Aesthetics Privacy Policy, available at [INSERT WEBSITE URL] or upon request from the clinic.

 

 

9.  Regulatory Compliance — AHPRA and Therapeutic Goods Advertising Code

9.1  All Programme content, social media, and marketing materials are intended to comply with the AHPRA Guidelines for Advertising Regulated Health Services and the Therapeutic Goods Advertising Code 2021 (Cth).

9.2  No content in the Programme constitutes a guarantee of outcome, a claim of cure, or a testimonial implying specific treatment results. Programme language is framed in accordance with regulatory requirements using terms such as "support," "help," and "designed to."

9.3  Before/after imagery, where used, is accompanied by the mandatory disclaimer required under the Therapeutic Goods Advertising Code and is not used in a misleading or deceptive manner.

10.  Limitation of Liability

10.1  To the maximum extent permitted by law, Avery Aesthetics excludes all liability for any loss or damage arising from your participation in the Programme, including indirect, consequential, or incidental loss.

10.2  Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.

10.3  Where Avery Aesthetics is liable to you for a failure to comply with a consumer guarantee under the Australian Consumer Law, our liability is limited (at our election) to: (a) resupply of the service or supply of an equivalent service; or (b) payment of the cost of having the service supplied again; or (c) in the case of goods, replacement, repair, or refund of the purchase price.

10.4  Avery Aesthetics does not warrant that the Programme's digital content will be uninterrupted or error-free. Where access is disrupted due to technical issues, we will use reasonable endeavours to restore access promptly.

 

 

11.  Participant Responsibilities

11.1  You warrant that the information you provide in the Skin Intelligence Quiz is accurate and complete to the best of your knowledge. Avery Aesthetics is not responsible for inaccurate routing or product matching resulting from incomplete or inaccurate quiz responses.

11.2  You are responsible for disclosing to your treating clinician any known allergies, skin conditions, medications, or medical history relevant to the sample products or in-clinic services offered as part of the Programme.

11.3  You must not use the Programme if you are under 18 years of age without the consent of a parent or legal guardian.

11.4  You agree not to access, reproduce, or distribute Programme content in a manner that infringes the intellectual property rights of Avery Aesthetics or any third party.

 

 

12.  Amendments

12.1  Avery Aesthetics reserves the right to amend these Terms at any time. Where amendments are material, we will provide reasonable notice via email to participants or by updating the Programme landing page. Continued participation after the effective date of any amendment constitutes acceptance of the revised Terms.

12.2  Avery Aesthetics reserves the right to modify, suspend, or discontinue any component of the Programme with reasonable notice. Where a component is discontinued before delivery, affected participants will be offered a pro-rata refund or equivalent alternative.

 

 

13.  Governing Law and Dispute Resolution

13.1  These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

13.2  In the event of a dispute arising from these Terms or your participation in the Programme, you agree to contact Avery Aesthetics in writing in the first instance to allow us the opportunity to resolve the matter directly. We will respond to all written complaints within 10 business days.

13.3  Nothing in this clause limits your rights to refer a complaint to a relevant regulatory body, including the Australian Competition and Consumer Commission (ACCC) or NSW Fair Trading, or to seek independent legal advice.

 

 

14.  General Provisions

14.1  Entire Agreement. These Terms, together with the Avery Aesthetics Privacy Policy, constitute the entire agreement between you and Avery Aesthetics in relation to the Programme and supersede all prior representations, discussions, or understandings.

14.2  Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining Terms will continue in full force.

14.3  No Waiver. Failure by Avery Aesthetics to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4  Assignment. You may not assign or transfer your Programme participation or any rights under these Terms without the prior written consent of Avery Aesthetics.
